Terms of Service
Legal Notice: This is a translation of the German Terms of Service. The German version is legally binding.
§ 1 Scope of Application
These Terms of Service (T&C) apply to all contracts between Benjamin Kruft, BewerbungsFreund (hereinafter "Provider" or "we", full provider details see § 16) and users of the platform bewerbungsfreund.de (hereinafter "User" or "You") regarding the use of offered services.
These T&C govern (i) the use of the platform and the services we provide as part of interview training ("Usage Agreement") and (ii) supplementary conditions related to the purchase and use of credits. The purchase contract for credits is concluded with us as the seller (see § 3.2). We use Stripe Technology Europe, Limited ("Stripe") as our payment service provider for payment processing.
Deviating, conflicting, or supplementary terms and conditions of the user shall not become part of the contract unless their validity is expressly agreed to in writing.
§ 2 Service Description
2.1 BewerbungsFreund Service
BewerbungsFreund is an AI-powered interview training system. The service includes:
- Generation of individual interview questions based on job type and optional job description
- Evaluation and feedback on your answers by AI
- Provision of sample answers and improvement suggestions
- PDF export of results
2.2 Free Trial Version
Users can try three (3) interview questions free of charge without registration. After the third question, the purchase of credits is required to complete the full training (12 questions).
2.3 Paid Services
After the free trial phase, users can purchase credits:
- 1 Credit = 1 complete interview training (12 questions)
- Prices and packages are visible on the website
- Credits are valid for three (3) years from purchase date and expire thereafter without replacement
2.4 Purpose and Use at Own Risk
Important Notice:
BewerbungsFreund is a pure training and practice tool. The service is exclusively intended for job interview preparation and improving your interview skills.
The use of all content, tips, feedback, and sample answers is expressly at your own risk and responsibility. The service does not replace professional career counseling, coaching, or individual career advice.
2.5 Service Development
We continuously develop our service to provide you with the best possible interview preparation. This may include adjustments to the structure and design of the trainings, in particular:
- Changes to the number and distribution of interview phases
- Adjustment of question distribution within phases
- Introduction of new or modification of existing features
Such changes are made only where (i) there is a legitimate reason (in particular improvement of quality and effectiveness), (ii) no additional costs arise for you, and (iii) you are informed about material changes in advance. The essential scope of services (total number of questions per training) remains unchanged.
Your statutory rights under §§ 327 ff. of the German Civil Code (BGB), particularly in case of disadvantageous changes to digital products pursuant to § 327r BGB, remain unaffected.
§ 3 Contract Formation and Registration
3.1 Registration
Registration is required to use paid features. Registration is done through:
- Google OAuth (Single Sign-On)
- LinkedIn OAuth (Single Sign-On)
- Email (Magic Link)
By registering, you confirm that the information you provide is complete and accurate.
3.2 Contract Formation for Purchases
The purchase contract for credits is concluded with us (BewerbungsFreund) as the seller. Payment is processed through our payment service provider Stripe Technology Europe, Limited ("Stripe"). The purchase takes the following steps:
- Selection of a credit package on our website (invitation to submit an offer)
- Redirect to Stripe checkout page
- Entry of payment details and confirmation by clicking "Buy Now" (your binding offer to us)
- Acceptance by us and automatic credit of credits after successful payment
3.3 Minimum Age
Use of our service (including the free trial) is only permitted for persons who have reached the age of 16. Persons under 16 may only use the service with the express consent of a parent or legal guardian.
Minors between 16 and 18 require the consent of a legal guardian for paid purchases.
Background: When using the service, your inputs are processed by AI service providers (currently OpenAI). The processing of personal data of minors under 16 requires the consent of the holder of parental responsibility pursuant to Art. 8 GDPR.
3.4 Contract Language and Storage
The contract language is German. The contract text is not stored by us after conclusion of the contract and is no longer accessible. Order data will be sent by email.
§ 4 Prices and Payment
4.1 Prices
Current prices are visible on the website. During checkout, the final price including the applicable VAT for your country is displayed. Automatic tax calculation is provided by Stripe Tax.
4.2 Payment Processing
Payment is processed through our payment service provider Stripe Technology Europe, Limited. Available payment methods include:
- Credit cards (Visa, Mastercard, American Express)
- PayPal
- Other methods supported by Stripe in your region
Availability of payment methods may vary by region. Payment processing is subject to Stripe's Terms of Service and Privacy Policy, as well as those of the respective payment provider.
4.3 Due Date
Payment is due immediately upon conclusion of the contract. Credits are credited immediately after successful payment confirmation by Stripe.
4.4 Price Changes
Prices may be adjusted at any time. The price displayed at the time of purchase is binding. Already purchased credits retain their full value.
4.5 Invoicing
You will receive an invoice from us by email after successful purchase. BewerbungsFreund (Benjamin Kruft) is shown as the seller and invoicing party.
§ 5 Right of Withdrawal
As a consumer, you have a statutory right of withdrawal. You may withdraw from your contract within fourteen days without giving any reason.

Notice Regarding Immediate Access:
If you choose immediate start at purchase, we begin performance before the withdrawal period expires. In case of withdrawal, compensation for credits already used is due. Details can be found in our Withdrawal Policy.
§ 6 Terms of Use
6.1 Permitted Use
The service may only be used for the following purposes:
- Personal preparation for job interviews
- Training and improving interview skills
- Personal development in a professional context
6.2 Prohibited Use
The following uses are expressly prohibited:
- Automated queries (bots, scraping, scripts)
- Misuse for generating content for third parties or commercial purposes
- Sharing of access data or account sharing
- Reverse engineering, decompilation, or disassembly
- Circumventing technical protection measures or rate limits
- Use to develop competing products
- Injection of malware or harmful content
6.3 Account Security
You are obligated to keep your access credentials confidential and protect them from access by third parties. If you suspect unauthorized access or misuse, please inform us immediately at kontakt@bewerbungsfreund.de.
If we have reasonable suspicion of misuse (e.g., unusual usage patterns, automated access, account sharing), we are entitled to temporarily suspend the account and request an explanation from you.
6.4 Chargebacks
In case of an unjustified payment chargeback by the user, even though the service was properly provided, we reserve the right to suspend the associated credits and deactivate the account until clarification. Additionally, we may claim the fees and processing costs incurred by the chargeback.

6.5 Provision of Content and Documents
When using our service (including PDF upload function, text inputs in forms, interview answers, profile information, job descriptions, etc.), you warrant that:
- You are authorized to use the provided content and forward it to our processing services (including AI providers)
- The provided content does not contain confidential, secret, business-critical, or unlawful information
- You possess all necessary rights to the provided content
- No personal data of third parties is transmitted unless there is a legal basis or consent; personal data of third parties should be anonymized or redacted where possible
- No trade secrets, confidential business information, or data protected by confidentiality agreements is entered
- The content does not violate applicable law (in particular no criminal, discriminatory, insulting, or youth-endangering content)
We assume no responsibility for the legality, confidentiality, or content of the information, texts, and documents you provide. You bear sole responsibility for ensuring that the transmitted content does not violate legal provisions, confidentiality obligations, or third-party rights.
6.6 Indemnification
You shall indemnify us against all third-party claims asserted against us due to unlawful or confidential content provided by you, infringement of copyrights or other intellectual property rights, violations of data protection regulations, or other violations of these T&C by you. The indemnification includes reasonable costs of legal defense including attorney and court fees.
6.7 Prohibited Content and Automatic Moderation
BewerbungsFreund is designed exclusively for preparation for legitimate, legal professions and activities. The following content is not permitted when creating interview training:
- Positions, descriptions, or profiles relating to illegal activities (e.g., drug trafficking, fraud, money laundering)
- Content related to the sex industry or sexual services
- Content that promotes or glorifies violence, hatred, or discrimination
- Content related to extremist or terrorist activities
- Other content that violates applicable law or is ethically unjustifiable
Automatic Content Review:
All entered positions, job descriptions, and profile information are automatically checked for compliance with our usage guidelines before creating an interview training. Requests that violate these guidelines will be automatically rejected.
This review is carried out to protect our users, our platform, and to comply with legal requirements. In case of repeated violations, we reserve the right to suspend the account in accordance with § 9.3.
§ 7 Availability and Warranty
7.1 Availability
We strive for the highest possible availability of the service. However, we cannot guarantee 100% availability. In particular, maintenance work, system updates, technical disruptions, or circumstances beyond our control may lead to temporary restrictions.
7.2 AI-Generated Content - Disclaimer
Important Disclaimer for AI Content:
The AI-generated content (questions, feedback, assessments, sample answers, tips, and improvement suggestions) is intended exclusively for practice and training purposes.
AI systems can make mistakes. The generated content may be inaccurate, incomplete, outdated, out of context, or inappropriate in individual cases.
We expressly do not warrant:
- The correctness, completeness, or timeliness of AI-generated content
- The suitability of content for specific application situations or specific companies
- Success in actual job interviews
- Compliance with industry-specific or cultural customs
- The legal harmlessness of suggested answers (e.g., regarding discrimination questions)
The application of all tips, suggestions, and sample answers in real job interviews is expressly at the user's own risk and responsibility. We recommend critically reviewing all content and, if necessary, seeking professional career counseling.
7.3 AI Service Provider
We currently use OpenAI as our service provider for AI functionality. We reserve the right to change or add AI service providers, provided they:
- offer a comparable level of data protection (particularly GDPR compliance)
- deliver appropriate quality for the intended use
- maintain industry-standard security practices
We will inform registered users in advance in text form (e.g., by email) about material changes to AI service providers. Where consent is required for such changes, we will obtain it separately. Users' statutory rights remain unaffected.
7.4 Third-Party Service Dependencies
Our service depends on the availability of third-party services, including AI services (currently OpenAI), payment processors (Stripe), email services, and hosting infrastructure.
Disclaimer for Third-Party Outages: We assume no liability for temporary or permanent outages, service limitations, quality reductions, or changes to these third-party services, provided such issues are beyond our control. For temporary disruptions, there is generally no entitlement to reimbursement solely due to short-term unavailability, provided we are not responsible for the disruption and the service can be made up. Statutory rights, particularly under §§ 327 ff. of the German Civil Code (BGB), remain unaffected.
Provider Substitution: Should a key third-party provider permanently cease operations, become insolvent, or no longer offer services at the required quality or reasonable cost, we are entitled to switch to a comparably capable replacement provider without prior notice.
Transition Period: If no equivalent replacement can be found within 90 days, users with unused credits are entitled to a pro-rata refund of the purchase price. Refunds are processed via Stripe.
7.5 Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control (force majeure), including:
- Natural disasters, pandemics, epidemics
- War, terrorist acts, civil unrest, sabotage
- Government orders or legal prohibitions
- Labor disputes (including at third-party providers)
- Widespread power, internet, or telecommunications outages
- Cyberattacks on critical infrastructure that could not be prevented despite reasonable security measures
If force majeure continues for more than 60 days making complete performance impossible, both parties have an extraordinary right of termination. Unused credits will be refunded proportionally via Stripe in this case.
7.6 Rights for Digital Products
For the provision of digital content and services, the provisions of §§ 327 ff. of the German Civil Code (BGB) apply in addition. In particular, you have the statutory rights in case of defects in digital products. The warranty is limited to the technical functionality of the service, not the content quality of AI-generated content (see § 7.2).
§ 8 Liability
8.1 Unlimited Liability
We are liable without limitation for damages resulting from injury to life, body, or health based on intentional or negligent breach of duty by us or our legal representatives or agents, as well as for damages caused by intent or gross negligence.
8.2 Limited Liability
In case of breach of material contractual obligations (cardinal duties) through simple negligence, our liability is limited to the foreseeable damage typical of the contract. Material contractual obligations are those whose fulfillment is essential for proper contract performance and on which the user can regularly rely.
The foreseeable damage typical of the contract for this service is limited to a maximum of the total amount paid by the user in the 12 months prior to the event causing the damage.
8.3 Exclusion of Liability
In particular, we are not liable for:
- Damages arising from following AI-generated tips, sample answers, or suggestions in real job interviews
- Missed opportunities, job offers not received, or missed career opportunities
- Damages due to erroneous, incomplete, or inappropriate AI-generated content
- Indirect damages, consequential damages, or lost profits
- Damages due to failures of third-party services
Users' statutory claims remain unaffected.
§ 9 Contract Duration and Termination
9.1 Duration
The contract is concluded for an indefinite period. This is not a subscription with recurring payments. Purchased credits are valid for three (3) years from the purchase date and expire thereafter without replacement.
9.2 Termination by User
You can delete your account at any time without notice through the account settings or by email to kontakt@bewerbungsfreund.de. Unused credits can be used until their expiry (3 years). No refund of unused credits upon termination, except in case of valid withdrawal.
9.3 Suspension and Termination by Provider
We may temporarily suspend or terminate the account for violation of prohibited use, provision of unlawful content, suspected fraudulent use, repeated violations despite warning, or other important reasons.
§ 10 Copyright and Usage Rights
10.1 Provider Rights
All content of the website and platform is protected by copyright and owned by the provider or its licensors.
10.2 User Rights to AI Content
We grant you a simple, non-transferable, non-sublicensable right of use to the AI content generated for you for personal, non-commercial purposes. Commercial reuse or publication is not permitted without our express consent. Sharing in a private context for job application purposes (e.g., with a coach, advisor, or for internal preparation) is permitted.
10.3 Rights to User Content
Content you enter during training remains your property. By using the service, you grant us the right to process your input for service provision (including forwarding to AI providers) and to use your input in anonymized and aggregated form for service improvement.
§ 11 Data Protection
Information on the processing of your personal data can be found in our Privacy Policy. This applies in addition to these T&C.
The processing of personal data is based – depending on the processing activity – on Art. 6(1)(b) GDPR (contract performance) or Art. 6(1)(f) GDPR (legitimate interests) and, where required, on consent pursuant to Art. 6(1)(a) GDPR. Details (including recipients, third-country transfers, and retention periods) are set out in the Privacy Policy.
§ 12 Changes to Terms of Service
12.1 Authority to Amend
We reserve the right to change these T&C with effect for the future where there is a legitimate reason, in particular (i) changes to legal requirements or case law, (ii) technical changes or further development of the service, (iii) closing of regulatory gaps.
12.2 Notice of Editorial or Legal Changes
Changes that are purely editorial in nature or are made solely to comply with mandatory legal requirements and do not adversely affect users will be announced at least four (4) weeks before taking effect in text form (e.g., by email).
12.3 Material Changes
Material changes that may shift the contractual balance to the detriment of users (in particular changes to main performance obligations, new fees, restrictions of essential usage rights) will only become effective if the user expressly consents. We will obtain consent at the next login or through separate confirmation.
12.4 Objection
If a user objects to a change, the previous T&C will continue to apply. We reserve the right to terminate the contractual relationship for good cause in this case, if adherence to the unchanged contract is unreasonable for us. Unused credits remain valid until their regular expiration date.
§ 13 Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Provisions
14.1 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the state in which the consumer has their habitual residence remain unaffected.
14.2 Place of Jurisdiction
Place of jurisdiction for all disputes arising from this contract is Neunkirchen (Saar), if the user is a merchant within the meaning of the German Commercial Code (HGB) or a legal entity under public law. For entrepreneurs who have no general place of jurisdiction in Germany, Neunkirchen (Saar) also applies as the place of jurisdiction. For consumers, the statutory place of jurisdiction provisions apply.
14.3 Assignment
The transfer of credits, accounts, or rights under this contract to third parties is not permitted without our prior written consent.
14.4 Severability Clause
Should individual provisions of these T&C be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
